Can I Settle My Arizona Worker’s Compensation Case?

Can I Settle My Arizona Worker’s Compensation Case?

After a workplace accident in Arizona, most injured employees can receive workers’ compensation benefits, including payment of all reasonable and necessary medical treatment and temporary or permanent disability benefits. In some cases, workers may settle their claims rather than receive workers’ compensation checks over time. However, accepting a workers’ compensation settlement is not the best resolution in every case. Consulting an experienced workers’ compensation attorney before accepting a settlement offer is advisable for anyone with a job injury or illness in Arizona.

Types of Workers’ Compensation Settlements in Arizona

In Arizona, an injured employee who has had their workers’ compensation claim accepted by their employer can negotiate a settlement of their accepted claim. A workers’ compensation settlement pays the injured worker in one of two ways — either as a lump sum or a structured settlement. A lump sum settlement pays the worker the entire settlement amount all at once, while a structured settlement pays compensation over multiple installments.

Traditionally, Arizona workers’ compensation settlements allowed injured workers to reopen their claims if they needed additional medical care to treat their work injuries. However, in 2017, Arizona adopted a bill that amended the Arizona Workers’ Compensation Act to expressly allow for a full and final settlement in workers’ compensation cases.

A full and final settlement is one where an injured worker waives the possibility of any future medical care for known conditions. The payor must submit a summary of anticipated future medical expenses and medical maintenance benefits and their cost, which must be included in the settlement.

A settlement offer may not be the most effective way to maximize your workers’ compensation benefits. With your health and financial well-being on the line, seeking legal guidance can help you determine your next best steps.

The Need for Legal Consultation Before Settling

Because settling a workers’ compensation claim may involve giving up critical rights and benefits, an injured worker should consult a workers’ compensation attorney before negotiating a settlement or accepting a settlement offer from their employer or the insurance company. A lawyer can help an injured worker calculate a fair settlement amount based on the benefits they can expect to receive throughout their workers’ compensation claim. A lawyer can also discuss the suitability of a full and final settlement and explain the ramifications of such a settlement to a worker.
